The Missing Sock Photography (TMS)

The Missing Sock Photography ("TMS," "we," "us") provides school and preschool photography services in Miami-Dade and Broward Counties, Florida. This policy explains what information we collect, how we use it, and the rights of schools, parents, and site visitors.

1. Information We Collect

From schools: Student roster information (name, grade, class) provided by the school solely to organize and deliver Picture Day services.

From parents/customers: Name, email, phone number, mailing address, and payment information when you register, order, or contact us.

Photographs: Images of students taken during school-authorized Picture Day sessions, and images of family/event clients who book directly with us.

From website visitors: Standard analytics data and, where enabled, data collected via tracking pixels (see Section 6, Cookies & Tracking).

2. How We Use Information

We use this information only to:

  • Deliver Picture Day photography services to the school and its families

  • Process orders, payments, and proofing galleries

  • Communicate with schools and parents about scheduling, delivery, and support

  • Improve our services

We do not sell student or customer personal information. We do not use student images for advertising or marketing without separate, explicit consent from a parent/guardian.

3. Children's Privacy (COPPA)

TMS's Picture Day services are provided through the student's school, which acts on behalf of parents under the school-authorized education exception recognized by the FTC's Children's Online Privacy Protection Act (COPPA), 16 CFR Part 312. This means:

  • The school authorizes photography and delivery of images for the educational/family purpose of Picture Day.

  • We do not use children's images or information for behavioral advertising or any commercial purpose beyond delivering the ordered photos.

  • If a private online gallery requires a login (e.g., by student name or access code), that gallery is access-restricted, not publicly searchable.

  • Parents may request access to, or deletion of, their child's photos and data by contacting us at Support@themissingsock.photo.

  • We do not knowingly collect personal information directly from children under 13 through our website.

4. Student Records (FERPA)

Where a school shares student information with TMS as part of Picture Day coordination, TMS acts as a school-authorized vendor. We do not redisclose, sell, or use that information for any purpose other than providing the contracted photography service, consistent with the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g.

5. Data Security & RetentioN

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, or disclosure. We retain student and customer data only as long as needed to deliver services and meet legal/business requirements, after which it is deleted or de-identified.

In the event of a data breach affecting personal information, we will notify affected individuals and, where required, Florida's Department of Legal Affairs, in accordance with the Florida Information Protection Act of 2014 (FIPA), Fla. Stat. § 501.171.

6. Cookies & Tracking Technologies

Our website may use cookies and pixel-based tools (including the Meta Pixel) to understand site traffic and measure the performance of our advertising. These tools may collect information such as pages visited and general device/browser data. They are not used to identify or target children. You can control cookies through your browser settings.

7. Your Rights

Parents and customers may:

  • Request a copy of the personal information we hold about them or their child

  • Request correction or deletion of that information

  • Opt out of marketing emails/SMS at any time (a link is included in every message, or contact us directly)

8. Third Parties

‍ ‍We may share information with service providers who help us operate (e.g., payment processing, gallery hosting, email delivery), under agreements that limit their use of the data to providing that service. We do not sell personal information to third parties.

9. Changes to This Policy

We may update this policy periodically. The "Effective date" above reflects the most recent revision. Material changes affecting student data will be communicated to partner schools directly.
