Welcome to The Missing Sock Photography ("TMS," "we," "us," "our"). These Terms & Conditions ("Terms") govern your use of our website and your purchase of any of our services: Picture Day, Mini Sessions, Family & Private Sessions, and Events. By booking a session, registering through your school, making a purchase, or otherwise using our website, you agree to these Terms.

Our Services

TMS provides:

  • Picture Day: school and preschool photography, coordinated through your child's school.

  • Mini Sessions: seasonal studio sessions booked directly by parents, open to families whether or not their school works with TMS.

  • Family & Private Sessions: lifestyle photography sessions booked directly with TMS.

  • Events: photography services offered to schools and to parents, with different terms depending on which party books.

Pricing, packages, and availability for each service are described on our website and may change without prior notice.

Who Can Agree to These Terms

Our sessions frequently involve minors. By registering for a session, signing a consent form, or completing a purchase, you confirm that:

  • You are the parent or legal guardian of any minor(s) participating in the session, or you are 18 years or older and participating as an adult client.

  • You have the authority to consent to photography of the minor(s) in your care.

  • A minor cannot accept these Terms or sign a photo consent form on their own behalf.

Photo Consent & Image Rights

Separate from these Terms, every session requires a signed Photo Session Consent form before any photography takes place. That form governs consent to be photographed and, where applicable, consent for TMS to use images in its portfolio or marketing materials.

  • TMS retains full commercial copyright and ownership of all images captured during a session, regardless of who appears in them.

  • Purchasing photographs grants you a personal, non-commercial license to use and print those images. You may not sell, license, or use purchased images for commercial purposes.

  • We will never use a child's full name alongside their image in any public-facing material, and we do not use children's images for advertising without a parent or guardian's separate, explicit consent, as described in our Privacy Policy.

Payments, Cancellations & Refunds

Payment terms, deposits, refund eligibility, and cancellation windows vary by service and are set out in full in our Cancellation & Refund Policy, which is incorporated into these Terms by reference. By completing a purchase, you agree to that policy.

Registration Information

If you register through your school (Picture Day) or directly with us (Mini Sessions, Private Sessions, Events), you agree that the information you provide, including names, contact details, and payment information, is accurate and current. You are responsible for keeping this information up to date so we can deliver your gallery, notifications, and receipts.

Prohibited Conduct

When using our website or services, you agree not to:

  • Scrape, copy, or systematically collect content or data from our website.

  • Attempt to access another family's or school's private gallery.

  • Use our website for any unlawful purpose or in a way that violates any applicable law.

  • Upload viruses, malicious code, or use bots or automated tools against our website.

  • Misrepresent your identity or your relationship to a child participating in a session.

Website Content & Intellectual Property

All content on our website, including photographs, text, graphics, and design, is owned by or licensed to TMS and protected by copyright and trademark law. You may view and print pages for personal, non-commercial use only. No content may be reproduced, republished, or used commercially without our written permission.

Privacy & Children's Data

We care about the privacy of the families and schools we work with. Please review our Privacy Policy, which explains what information we collect and how we handle it, including our practices under COPPA and FERPA for information involving minors. Our Privacy Policy is incorporated into these Terms by reference.

Third-Party Websites & Services

Our website may link to third-party services (for example, payment processors or gallery hosting platforms). We are not responsible for the content, accuracy, or practices of third-party websites. If you leave our website to visit a third-party site, you do so at your own risk.

Disclaimer & Limitation of Liability

Our website and services are provided on an "as is" and "as available" basis. While we take care in photographing, editing, and delivering your images, we do not guarantee that every specific pose, expression, or shot will meet individual expectations, weather, timing, and each child's participation can affect results.

To the fullest extent permitted by law, TMS and its photographers, employees, and contractors are not liable for indirect, incidental, or consequential damages arising from your use of our services or website, including damages related to session scheduling, image delivery timelines, or third-party printing of purchased images.

Indemnification

You agree to defend and hold TMS harmless from any claim arising from your breach of these Terms, your misuse of our website, or false information you provide during registration.

Governing Law & Disputes

These Terms are governed by the laws of the State of Florida. Any dispute arising from these Terms or your use of our services will be brought in the state or federal courts located in Miami-Dade County, Florida. No claim may be brought more than one (1) year after it arose.

Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of our website or booking of a session after changes are posted means you accept the updated Terms.
